BREAKING: Jonathan Pollard To Be Released In November

0

STATEMENT OF ELIOT LAUER AND JACQUES SEMMELMAN
ATTORNEYS FOR JONATHAN J. POLLARD

NEW YORK, NY (July 28, 2015) The U.S. Parole Commission has issued a Notice of Action granting parole to our pro bono client Jonathan J. Pollard.
Mr. Pollard is scheduled to be released on parole November 21, 2015. He has been in prison since November 21, 1985. We are grateful and delighted that our client will soon be released.
The decision to grant parole was made unanimously by the three members of the Parole Commission, who make their decisions independently of any other U.S. government agency. The decision is not connected to recent developments in the Middle East. Had parole been denied, Mr. Pollard would have been required to serve an additional fifteen years in prison.
The Notice of Action follows a parole hearing that took place July 7, 2015 at the Federal Correctional Center in Butner, North Carolina, where Mr. Pollard has been incarcerated. He has been serving a sentence of life in prison for conspiracy to deliver classified information to the State of Israel.
This was Mr. Pollard’s second parole hearing. At his first hearing, in July 2014, parole was denied. At that time, the Parole Commission informed us that nine months before the two-thirds mark of Mr. Pollard’s life sentence (deemed for this purpose to be 45 years), the Parole Commission would perform a “record review” and assess whether, in its discretion, Mr. Pollard should be released on parole at the two-thirds mark of the 45-year term, i.e., on November 21, 2015.
The Parole Commission performed a “record review” but, to our great disappointment at the time, declined to consider granting parole without first conducting an adversarial hearing, at which representatives of the U.S. Department of Justice (DOJ) would be present. The issues for the hearing, as set forth in the federal parole statute, were (a) Mr. Pollard’s record in prison, and (b) whether there was a “reasonable probability” that Mr. Pollard would commit any further crimes if released.
Over the next several months, in advance of the hearing, we engaged in dialogue with the DOJ, and submitted extensive written materials to the Parole Commission and the DOJ in support of parole, demonstrating that Mr. Pollard had an exemplary prison record, and that there was no possibility that he would commit any further crimes if released. We also secured employment and housing for Mr. Pollard in the New York area, and made that information available to the Parole Commission as well as the DOJ.
On July 1, 2015 the DOJ finally informed us that it agreed not to urge denial of parole at the hearing scheduled for July 7, 2015.
The Notice of Action requires Mr. Pollard to remain in the United States for five years. President Obama, who has the constitutional power of executive clemency, has the authority to release Mr. Pollard before November 21, 2015, as well as the authority to allow Mr. Pollard to leave the United States and move to Israel immediately. We respectfully urge the President to exercise his clemency power in this manner.
Mr. Pollard has asked us to communicate the following on his behalf:
• Mr. Pollard is looking forward to being reunited with his beloved wife Esther.
• Mr. Pollard is deeply grateful to his longstanding pro bono lawyers Eliot Lauer and Jacques Semmelman, and their law firm Curtis, Mallet-Prevost, Colt & Mosle LLP, who stood by him for so many years, and whose perseverance, creativity, and forceful advocacy were instrumental in securing his release on parole.
• Mr. Pollard is also extremely thankful to the National Council of Young Israel, especially Rabbi Pesach Lerner, who worked tirelessly for many years on Mr. Pollard’s behalf, as well as Farley Weiss, President of the National Council of Young Israel, for his ongoing dedication and support.
• Others who Mr. Pollard wishes to thank publicly include David Nyer, Kenneth Lasson, and George Leighton, for their work on his behalf in the United States; and Larry Dub, Nitsana Dirshan-Leitner, Effi Lahav, Asher Mivtari, and Adi Ginsburg for their work on his behalf in Israel. Mr. Pollard is mindful that others have helped as well, and he thanks them all.
• Finally, Mr. Pollard would like to thank the many thousands of well-wishers in the United States, in Israel, and throughout the world, who provided grass roots support by attending rallies, sending letters, making phone calls to elected officials, and saying prayers for his welfare. He is deeply appreciative of every gesture, large or small.
We look forward to seeing our client on the outside in less than four months.

Thousands Protest the Iran Nuclear Deal

Thousands Protest the Iran Nuclear Deal And Send Congress A Clear Message in Los Angeles and San Diego, July 26, 2015

STOP IRAN NOW rallies took place yesterday (July 26, 2015) as thousands gathered  to protest  the Iran Nuclear Deal in Los Angeles and San Diego.  Students and community members of all  faiths stood together in both cities to urge Congress to vote NO and hold strong for an agreement that would protect the U.S. and our allies and prevent a nuclear Iran and the high likelihood of nuclear terrorism.

Brandishing signs that implored “The World Cannot Afford A Nuclear Iran,” and reminded that, “A Nuclear Iran Threatens All Of Us” and warned, “Don’t Let Our Kids Inherit a Nuclear Iran,” the signs and speakers conveyed a clear message – that people will not tolerate a nuclear Iran, nor a congress that allows that to happen.   Letters were signed in English and Spanish, which will be delivered to Congress.  People were urged to continue their activism for the next 50 days. Attendees were told to pick up a pen, a phone and let congress hear their voices about this dangerous moment in history.
A message repeated by many speakers at both rallies included the grave concern that giving funds  to the most dangerous exporter of terrorism today would endanger the entire world. That the Iran deal in its current form actually paves the way to a nuclear Iran within the next 15 years. That a country that shouts “Death to America, Death to England and Death to Israel” and who created and funds the terrorist group Hezbollah, (with cells around the world) should not be trusted.
Los Angeles rally speakers included StandWithUs CEO and co-founder Roz Rothstein who also introduced each person.  They speakers included:  Reza Farahan, star of Bravo TV’s “Shahs of Sunset;” Dennis Prager, syndicated radio talk show host; Roozbeh Farahanipour, head of Iranian anti-regime dissident group “Marz-e por Gohar;” Televangelist Hazem Farraj; Pastor Lorraine Coconato,  Leaves of Healing Faith Tabernacle; Rabbi Elazar Muskin of Young Israel of Century City, Rabbi David Wolpe, Sinai Temple; LA District Attorney Elan Carr; Pastor Waymen Ming, Higher Vision Church in Valencia; David Suissa, journalist, Tribe Media Corp.;  Pastor Kevin Dieckilman, Simi Hills Christian Church of Simi Valley; Rabbi Yonah Bookstein of the Pico Shul and Rabbi Marvin Heir, Simon Wiesenthal Center
Caroline Glick, managing editor of the Jerusalem Post was one of the speakers at the San Diego rally,  riveting the audience as she did the 12,000 who attended the STOP IRAN New York rally on July 21.  Also in San Diego, Emcee John Davidi kept the rally moving as speakers gave impassioned talks about the grave threat a nuclear Iran poses to the world. Speakers in San Diego included: Sara Schoonmaker, Associate Director of StandWithUs San Diego, AIPAC representative Daniel Schwimmer, Rabbi Arnold Kopikis, Pastor Jim Garlow and Rosemary Schindler Garlow of the Skyline Church, college student Gracie Walker, attorney Mitch Danzig, politician Philip Graham and the American National Anthem was sung by songwriter, Jonathan Valverde.

SUMMER CAMP WITH GUNS

SUMMER CAMP WITH GUNS
By Benyamin Korn

(Mr. Korn, former executive editor of the Philadelphia Jewish Exponent and the Miami Jewish Tribune, is chairman of the Philadelphia Religious Zionists.)

Summer camp can mean very different things to different kids.

For Jewish children, summer camp means squirt guns and color wars.

For Palestinian Arab children, summer camp means training with real guns and preparing for actual war–jihad–against Israel.

The watchdog group “Palestinian Media Watch” recently exposed what has been going on this summer in a camp called “Jerusalem in the Eyes of the Lion Cubs and Flowers of Palestine,” held in the Nablus (Shechem) region.

The camp, it should be noted, is not an independent operation. It is sponsored by the Palestinian Authority’s National Security Forces, together with the “Lion Cubs and Flowers of Palestine,” which is the Fatah youth movement. Fatah, the largest component of the PLO, is headed by PA chairman Mahmoud Abbas.

More than 150 Palestinian children attended this summer’s camp. They were selected apparently because they are “children of martyrs and prisoners,” that is, the children of terrorists who were killed or captured after murdering Israelis – or trying to. It’s one of the many ways that the Palestinian Authority rewards and encourages terrorism. Some of the other methods are: salaries for imprisoned terrorists, monthly payments to the families of dead terrorists, and university scholarships for children of terrorists.

One of the “games” that the Lion Cubs have been playing this summer involves pretending that they are prisoners being mistreated by Israeli interrogators. The winner is the child who murders an Israeli guard, escapes, and ignites an armed revolt.

Closing ceremonies at the camp were broadcast on Fatah’s Awdah Television. Palestinian children in military uniforms danced and paraded with real weapons, including AK-47 rifles. Among the attendees nodding and clapping were the PA’s District Governor for Nablus, Akram Rajoub; Fatah’s Nablus regional secretary, Jihad Ramadan (that’s right, his first name is “Jihad”); and official representatives of the PA National Security Offices.

Unfortunately, the international news media gave very little coverage to the PA’s Little Terrorists Summer Camp. Maybe the fact that they have these camps every summer means it’s “old news.” Or maybe some media outlets just aren’t inclined to highlight news that discredits the Palestinian cause.

In the meantime, though, Jewish summer camps have been in the news, although for quite a different reason. The Olin-Sang-Ruby Union Institute, a Reform Jewish camp in Wisconsin, announced that from now on, all maps drawn by campers must include the Green Line. And the national director of the National Ramah Commission declared that maps used at Ramah camps are being redesigned “to make the Green Line more prominent.”

This remarkable bit of summertime revisionism may be politically correct, but it makes a mockery of the historical record.

Evidently Olin-Sang-Ruby and Ramah do not know–or do not care–that the “Green Line” is not a border, because it was never accepted by Israel – or by any Arab entity – as a border; it simply marks the points to which the Arab armies advanced in 1948, in their unsuccessful attempt to annihilate the newborn State of Israel. The fact that an Arab tank happened to reach a certain hill does not make that hill part of a border or of “Arab territory.” In technical terms, it’s simply an armistice line.

Moreover, much of the “Green Line” has been erased by Israel’s natural post-1967 development. For example, there are parts of Jerusalem, in the neighborhoods of Ramot, French Hill, and elsewhere, where one street was once on one side of the “Green Line” while the adjacent street was on the other; but somebody walking down those streets today cannot see where that division once existed. There is a new reality.

The term “West Bank,” which the Green Line is supposed to delineate, has no historical or geographical validity. There are Palestinian Arab towns in the “West Bank” that are more than forty miles from the Jordan River–making the “West Bank” the largest river bank in the world, if one uses that term literally. The areas delineated by the “Green Line” do not constitute a legitimate entity, but are an accident of war. The accurate historical names for those regions are Judea and Samaria, and the Jewish claim to Judea-Samaria –in history, international law, and Judaism– is far stronger than any Arab claim.

The current arrangements in Judea-Samaria make the “Green Line” even more obsolete. In 1995, Prime Minister Yitzhak Rabin withdrew from the cities where 95% of the Palestinian Arabs reside. The “occupation” of the Palestinians ended, and the Palestinian Authority took over about 40% of Judea-Samaria. The current map delineating the PA-controlled areas is complex and intricate; it does not resemble Colorado or Montana. A history lesson in a summer camp might discuss these details, but the notion that every map drawn by campers with magic markers or paint brushes should reflect these geographic details is absurd.

Add to all of this an ironic footnote: While some Jewish summer camps are adding the fictitious Green Line to their maps in the hope of appeasing the Palestinians, the Palestinian summer camps have no interest in the Green Line. They regard all of Israel as “Palestine,” and they are busy training their campers to take part in the Jihad to conquer it all.
